Examples of recent questions relating to the Together Personal Finance Conveyancing Panel
Am I correct in assuming that the fact that my solicitor is not identified on the Together Personal Finance Conveyancing panel that there is a problem with the standard of the firm’s conveyancing?
It would not be wise to jump to that conclusion. There are all sorts of perfectly reasonable explanations. A recent report by the solicitors regulator indicated 76% of law firms surveyed had been removed from at least one lender panel. The most common reasons for removal are: (1) lack of transactions (2) the lawyer is a sole practitioner (3) as part of the HSBC panel reduction (4) regulatory contact by SRA (5) accidental removal. If you are concerned you should simply call the firm and ask them why they are no longer on the approved list for Together Personal Finance.
We are due to exchange on the purchase a house but as a result of damage from the recent storms I have agreed compensation from the seller of £3k approx by way of a reduction in the price. This was going to be dealt with as part of the conveyancing process but my mortgage company Together Personal Finance will not agree to this. Why was Together Personal Finance even consulted?
Your lawyer being on the Together Personal Finance conveyancing panel is duty bound to inform Together Personal Finance of any changes to the purchase price. If you were to refuse your lawyers to disclose the reduction to Together Personal Finance then they would have to discontinue acting for you and Together Personal Finance.
I am planning to acquire a house and need a conveyancing solicitor in Liverpool who is on the Together Personal Finance approved. Could you point me in the right direction as regards a firm?
Our service is a directory service for firms who wish to be listed as being on the approved conveyancing panel for Together Personal Finance . We don’t recommend any particular firm.
Can you clarify what the consequences are if my solicitor is suspended from the Together Personal Finance Conveyancing panel prior to completion?
The first thing to point out is that, this is a very rare occurrence. In most cases even where a law firm is removed off of a panel the lender would allow the completion to go ahead as the lender would appreciate the difficulties that they would place you in if you have ti instruct a new solicitor days before completion. In a worst case scenario where the lender insists that you instruct a new firm then it is possible for a very good lawyer to expedite the conveyancing albeit that you may pay a significant premium for this. The analogous situation is where a buyer instructs a lawyer, exchanges contracts and the law firm is shut down by the regulator such as the SRA. Again, in this situation you can find lawyers who can troubleshoot their way to bring the conveyancing to a satisfactory conclusion - albeit for a fee.
My wife and I have arranged a further advance on our mortgage from Together Personal Finance as we wish to carry out alterations or improvements our home. Do we need to appoint a solicitor on the Together Personal Finance conveyancing panel to deal with the legals?
Together Personal Finance would not normally appoint a member of their conveyancing panel to deal with such a matter. If they did require any legal work then you would need to ensure that such a lawyer was on the Together Personal Finance panel
We have agreed to purchase a house. One unusual aspect is that the roof has a solar panel. Together Personal Finance have issued a mortgage offer so presumably this is not a concern to them. Why is my solicitor raising questions about the panel?
Given that you are obtaining a mortgage with Together Personal Finance your lawyer must to check the Together Personal Finance conveyancing instructions contained in the Part of CML Handbook for Together Personal Finance . The CML Handbook contains minimum requirements for solar panel roof-space leases, and solicitors are required to report to Together Personal Finance where a lease does not meet these requirements. The requirements relate to the installation of panels on properties in England and Wales. The CML are developing guidance for Northern Ireland and Scotland.
I'm in the throws of viewing houses and am about to put in an offer. Should I already have a conveyancer appointed at this stage? I intend to finance via a home loan with Together Personal Finance
It would be sensible to have your start your search soon rather than later. Once you decide who you want to use and once your offer is accepted you can instruct them to work for you and pass their details on the the estate agent. As you are getting a mortgage with Together Personal Finance , ask your prospective lawyers check they are on the Together Personal Finance conveyancing panel otherwise they can't do the mortgage legal work.
