Much to my surprise I have been told by my IFA that my property lawyer is not on the Nedbank Conveyancing panel. What can I do to be certain that this is indeed the case?

The short answer to your last question is that, notwithstanding the potential for a conflict of interest, you and Nedbank are the client. A precondition to being on the Nedbank approved panel is to comply with the CML Handbook requirements (last updated for this lender on Nedbank). The CML Handbook conditions require your lawyer to disclose issues such as defects will the lease so that Nedbank can be afforded the opportunity to check with their valuer as to the extent that the value of the property is affected . Should you refuse to allow your lawyer to make the appropriate notification then your lawyer will have no choice but to discontinue acting for you.

You will need a solicitor but they need not be on the Nedbank conveyancing panel. You will need a solicitor to draw up the transfer and to deal with the Land Registry formalities. The only thing you need to consider is that by selling at an undervalue so ask your lawyer about the implications. There could be an inheritance tax issue if you die within 7 years of this. As the property is your main residence you need not pay CGT but you should speak with your accountants in any event.
