Is there a reason why all property lawyers aren't included on the Nationwide BS Conveyancing panel?
Even though it may seem unfair for Nationwide Building Society to restrict who can act for them from the public’s or solicitor’s point of view, the other side of the coin is that the lenders are becoming ever more anxious and feel the necessary need to protect them from mortgage fraud and other illegal activities. My husband and I intend to remortgage our flat with Nationwide BS. We have a son 19 who lives with us. The solicitor on the Nationwide Building Society conveyancing panel requested us to identify anyone over the age of 17 other than ourselves who reside at the property. Our lawyer has now e-mailed a document for our son to sign, waiving any legal rights in the event that the apartment is repossessed. I have a couple of concerns (1) Is this document specific to the Nationwide BS conveyancing panel as he never had to sign this form when we bought 4 years ago (2) In signing this form is our son in any way compromising his right to inherit the property?
On the face of it your lawyer has done nothing wrong as it is established procedure for any occupier who is aged 17 or over to sign the necessary Consent Form, which is purely to state that any rights he has in the property are postponed and secondary to Nationwide BS .This is solely used to protect the Nationwide Building Society if the property were re-possessed so that in such circumstances, your son would be legally obliged to leave.

It does not impact your son’s right to inherit the apartment. Please note that if your son were to inherit and the mortgage in favour of Nationwide BS had not been discharged, he would be liable to take over the loan or pay it off, but other than that, there is nothing stopping him from keeping the property in accordance with your will or the rules of intestacy.

My conveyancers in Liverpool have advised me that they can not locate my conveyancing file. At the time of my purchase I took out a mortgage with Nationwide BS. Is it case that being on the Nationwide Building Society conveyancing panel they need to have retained the file for a number of years?
Different lenders have different requirements but many of the Terms and Conditions of Conveyancing Panel Appointment require the file to be held for a period of 6 years. That being said we have not seen a copy of the Nationwide BS Conveyancing Panel Terms. It might be worth you contacting Nationwide Building Society directly.

There is no definitive answer here. Have Nationwide Building Society conducted the survey? Have you advised Nationwide BS as your lawyers details and checked that your lawyer is on the Nationwide Building Society conveyancing panel? It is not unusual for a mortgage offer to take a month to come through
My brother and I have had an offer accepted on a flat I spoke to a solicitor recommended by my mum and he suggested instructing a solicitor approved by Nationwide BS. The estate agent recommended two local firms so I asked Nationwide Building Society if the 2 suggested solicitors are approved, which they are not. Nationwide BS suggested that either practice can fill out the appropriate forms to become approved. Do I (1) save myself the aggravation and use one of Nationwide Building Society 's conveyancing panel solicitors (2) Use the local solicitor and accept there may be delays etc as they go through the approval process.
Ask Nationwide BS for conveyancing panel firms in your area. Lenders have them all over the country. You can also use our search tool at the top of this page to search for a lawyer on the Nationwide Building Society conveyancing panel based on location. If you particularly like the sound of one of the local lawyers that you have spoken to ask them if they would go onto Nationwide BS conveyancing panel as it may only take about 2-3 weeks. As long as they meet Nationwide Building Society’s requirements it can be a very simple job for the solicitor. Other stuff will be going on in parallel (as you are at an early stage) so it may not delay matters.

There is little point in complaining directly to Nationwide Building Society. Every solicitor firm and conveyancer must have a complaints procedure. You can get information from the solicitor’s or conveyancer’s website or ask at their office. They must tell you about it if you ask.

The Legal Ombudsman will make sure that your complaint is addressed by the solicitor. It can also advise you how to complain.
