My husband and I are hoping to buy a 1 bedroom apartment in Newcastle with a mortgage from Mortgage Express (No 2). We like our lawyer but Mortgage Express (No 2) says she’s not on their "panel". It seems we have little choice but to instruct one of the Mortgage Express (No 2) panel solicitors or keep our solicitor and pay for one of their panel ones to represent them. Until recently, most lenders had large numbers of law firms on their panels: a borrower could choose one for themselves, as long as it was on the lender's panel. The lender would then simply instruct the borrower's lawyers to act for the lender, too. You can use your lender's panel lawyers or you could borrow from another lender which does not restrict your choice. A further alternative is for your solicitors to apply to be on the conveyancing panel for Mortgage Express (No 2)
can you help? My solicitor is informing me me that he is legally obliged to order a Local Authority search stemming from the fact that the firm are on the Mortgage Express (No 2) conveyancing panel. Is this really necessary?
Unfortunately both you and your lawyer have little choice here. Given that you are taking out a loan with Mortgage Express (No 2) your lawyer has to comply with their conditions as set out in their version of the CML Conveyancing Handbook. Your lawyer would have previously signed the Terms and Conditions of Mortgage Express (No 2)’s conveyancing panel appointment which obliges them to follow the CML Handbook requirements last updated Mortgage Express (No 2). even if you were a cash buyer you would be ill advised not to carry out a local authority search.

My lawyers in Manchester have advised me that they can not locate my conveyancing file. At the time of my purchase I took out a mortgage with Mortgage Express (No 2). Is it case that being on the Mortgage Express (No 2) conveyancing panel they need to have retained the file for a number of years?
It very much depends from lender to lender but many of the Terms and Conditions of Conveyancing Panel Appointment require the file to be held for a period of 6 years. That being said we have not seen a copy of the Mortgage Express (No 2) Conveyancing Panel Terms. It might be worth you contacting Mortgage Express (No 2) directly.
My brother and I have agreed a price on a apartment I spoke to a conveyancer previously used by my brother and he advised using a law firm approved by Mortgage Express (No 2). The estate agent recommended two local firms so I asked Mortgage Express (No 2) if the 2 suggested solicitors are approved, which they are not. Mortgage Express (No 2) suggested that either firm can fill out the appropriate forms to become approved. Do I (1) save myself the aggravation and use one of Mortgage Express (No 2) 's conveyancing panel solicitors (2) Use the local solicitor and accept there may be delays etc as they go through the approval process.

As long as the conveyancer is on the Mortgage Express (No 2) panel she or he must comply with the CML Handbook requirements for Mortgage Express (No 2). Unless your lawyer obtains specific confirmation in writing that Mortgage Express (No 2) will go ahead your lawyer has no choice but to refrain from exchanging contract and committing you to the purchase. We would suggest that you ask Mortgage Express (No 2) to contact your lawyer in writing confirming that they will accept the remaining number of years left on the lease.

Mortgage companies tend not to not issue a mortgage until they have details of a lawyer on their panel. It can take a few weeks for Mortgage Express (No 2) to deal with your lawyers application to be on the Mortgage Express (No 2) conveyancing panel. There's no guarantee that your solicitors will be accepted.
