A solicitor my fiance and I wanted to use for conveyancing on a purchase said he will levy higher legal fees if my lender is due to their unusual legal requirements. Am I likely to be frustrated using ModaMortgages? Any comments will be appreciated
ModaMortgages conveyancing requirements for their panel are no better or no more complicated than most lenders.
It is the case now the CML Handbook, the "bible" used by solicitors to establish lender requirements, is different for each lender.
It is not clear if your lawyer is on the ModaMortgages conveyancing panel. If they are not, this does add further risk of delay as ModaMortgages will appoint their own solicitors to look after their interest.

You have limited options available to you. As you are taking a mortgage with ModaMortgages your lawyer has to comply with their conditions as set out in their version of the CML Conveyancing Handbook. Your lawyer would have previously signed the Terms and Conditions of ModaMortgages’s conveyancing panel appointment which obliges them to follow the CML Handbook requirements last updated ModaMortgages. even if you were a cash buyer you would be ill advised not to carry out a local authority search.
Your search tool is useful but there are many lawyers listed near Middlesbrough on the ModaMortgages conveyancing panel. It would be a lot more helpful if you could recommend a specific firm on the ModaMortgages approved panel?
We do not recommend specific firms as the right firm for you depends on where your priorities lie. For example you may require a local firm with local knowledge or you might be looking for the low cost conveyancing. Before you appoint your lawyer we advise you to speak to two or three of the firms listed to gain comfort as to which one is right for you..
The firm that I recently instructed on my house acquisition in Brighton has suddenly shut down. They were on acting for me because I needed a solicitor on the ModaMortgages conveyancing panel and my previous lawyer was not. I gave my credit card details for them to take £175 for searches. What are my options?
If you have an estate agent involved then let them know immediately so that they advise the vendors that there may be a slight delay due to the problems encountered. Most sellers would be sympathetic and urge their lawyer to send a new set of papers to your new solicitors. You should appoint new lawyers that are on the ModaMortgages conveyancing panel and notify the lender. If you have paid over any money it will hopefully be held by the SRA as money in an intervened firm's bank accounts is transferred to the SRA. Then, the SRA or the intervention agent looks at the intervened firm's accounts to work out who the money belongs to. To claim your money you will need to contact the SRA. If the SRA cannot return money you are owed from the firm's bank accounts, or if they can only return part of the money, you can apply to the Compensation Fund for a grant. You should start obtaining conveyancing quotes from solicitors ASAP. After you have chosen your lawyer and once your offer is accepted you can instruct them to work for you and pass their details on the the EA. As you are getting a mortgage with ModaMortgages , make sure you remember to check that your lawyer is on the ModaMortgages conveyancing panel.
I am selling my apartment. I had a double glazing fitted in month 7 but did not receive a FENSA certificate or Building Regulation Certificate. My purchaser’s lender, ModaMortgages are being pedantic. The solicitor who is on the ModaMortgages conveyancing panel is happy to accept ‘lack of building regulation’ insurance but ModaMortgages are requiring a building regulation certificate. Why do ModaMortgages have a conveyancing panel of they don’t accept advice from them?
It is probably the case that ModaMortgages have referred the matter to their valuer. The reason why ModaMortgages may not want to accept indemnity insurance is because it does not give them any reassurance that the double glazing correctly and safely installed. It merely protects against enforcement action which is very unlikely anyway.
