My lawyer is not listed on the Marsden Building Society Conveyancing Panel. Can I still continue with my preferred solicitor notwithstanding that they are not on the Marsden Building Society panel?
You have a number of options available to you here:
- Carry on with your existing solicitors but Marsden Building Society will need to instruct a lawyer on the Marsden Building Society conveyancing panel. This will result in additional cost and potential delay.
- Get a new solicitor to act in the purchase, obviously checking they are on the Marsden Building Society conveyancing panel.
- Urge your lawyer to apply to join the Marsden Building Society lender panel

Unfortunately both you and your lawyer have little choice here. Given that you are taking out a loan with Marsden Building Society your lawyer has to comply with their conditions as set out in their version of the CML Conveyancing Handbook. Your lawyer would have previously signed the Terms and Conditions of Marsden Building Society’s conveyancing panel appointment which obliges them to follow the CML Handbook requirements last updated Marsden Building Society. even if you were a cash buyer you would be ill advised not to carry out a local authority search.

Hopefully they will be sympathetic and urge their lawyer to send a new set of papers to your new solicitors. If you have paid over any money it will hopefully be held by the SRA as money in an intervened firm's bank accounts is transferred to the SRA. We are not aware of any lender fees to be on their panel although some do charge an administration charge to deal with the processing of the conveyancing panel application.
I can not work out if my mortgage offer requires a lease extension . I have called into my local branch Marsden Building Society on numerous occasions and was told they are content with the situation and they would lend. As long as the conveyancer is on the Marsden Building Society panel she or he must comply with the CML Handbook requirements for Marsden Building Society. Unless your lawyer obtains specific confirmation in writing that Marsden Building Society will go ahead your lawyer has no choice but to refrain from exchanging contract and committing you to the purchase. We would suggest that you ask Marsden Building Society to contact your lawyer in writing confirming that they will accept the remaining number of years left on the lease.

The estate agent will want to know who your solicitors are (make sure these solicitors are on the lenders panel). Call up Marsden Building Society or your broker and complete any relevant paperwork. Marsden Building Society will tell you what documents they want. Marsden Building Society will instruct a valuer. The valuer will get in touch with the estate agent or seller to book an appointment. Once conducted (assuming no problems) it takes about week to get a mortgage offer. Marsden Building Society will issue the offer to you and your lawyer. The transaction will then take it’s course according the nature and complexity of the conveyancing.
