I am obtaining a mortgage with JPMorgan. I would like to employ the services of a Licensed Conveyancer. Does the JPMorgan Conveyancing panel include conveyancers regulated by the CLC
JPMorgan’s approved solicitor list is, like many other lenders associated to the CML or BSA, open to Licensed Conveyancers regulated by the Council of Licensed Conveyancers.
My fiance and I intend to remortgage our penthouse with JPMorgan. We have a son approaching twenty who lives with us. The solicitor on the JPMorgan conveyancing panel requested us to identify anyone over the age of 17 other than ourselves who lives in the flat. The solicitor has now sent a form for our son to sign, waiving any legal rights in the event that the apartment is repossessed. On the face of it your lawyer has done nothing wrong as it is established procedure for any occupier who is aged 17 or over to sign the necessary Consent Form, which is purely to state that any rights he has in the property are postponed and secondary to JPMorgan .This is solely used to protect the JPMorgan if the property were re-possessed so that in such circumstances, your son would be legally obliged to leave.

It does not impact your son’s right to inherit the apartment. Please note that if your son were to inherit and the mortgage in favour of JPMorgan had not been discharged, he would be liable to take over the loan or pay it off, but other than that, there is nothing stopping him from keeping the property in accordance with your will or the rules of intestacy.

There is nothing to stop you using your solicitor but JPMorgan will insist on their interests being represented by a firm on their conveyancing panel. There is greater potential for delays and confusion with an additional lawyer added to the mix, and it will undoubtedly be more expensive too.

As a firm of solicitors, in order to be on the JPMorgan conveyancing panel they would need to be regulated by the Solicitors Regulatory Authority. Many lenders do allow licenced conveyancers on their panel in which case such firms would be regulated by the Council of Licensed Conveyancers (CLC).

I have had an offer accepted on a flat I spoke to a lawyer recommended by my uncle and he suggested retaining a solicitor approved by JPMorgan. The estate agent recommended two local firms so I asked JPMorgan if the 2 suggested solicitors are approved, which they are not. JPMorgan suggested that either firm can fill out the appropriate forms to become approved. Do I (1) save myself the aggravation and use one of JPMorgan 's conveyancing panel solicitors (2) Use the local solicitor and accept there may be delays etc as they go through the approval process.
