Clydesdale Bank Conveyancing Panel : Questions and Answers

On what basis would a firm of solicitors be removed from the Clydesdale Bank solicitor panel?
According to a recent survey report by the solicitors regulator three quarters of solicitor practices had been removed from a lender panel. The most common reasons in order are :
  1. Low volume of transactions
  2. the lawyer is a sole practitioner
  3. as part of the HSBC panel reduction
  4. regulatory contact by SRA
  5. accidental removal. We are not aware of the specific or common criteria for removal by Clydesdale Bank
My god-son is buying a new build apartment with a mortgage from Clydesdale Bank. His solicitor has advised him of a delay in completing the ‘Disclosure of Incentive Form’. What is this document - I have never come across this before?
The form is intended to provide information to the main parties engaged in the purchase. Therefore, it will be provided to your son’s lawyer who should be on the Clydesdale Bank conveyancing panel as a standard part of the process, and to the surveyor when requested.

The Developer will be required to start the process by downloading the form and completing it.

The form will therefore need to be available for the valuer at the time of his or her site visit. The form should be sent to the Clydesdale Bank conveyancing panel solicitor as early as possible, in order to avoid any last minute delays, and no later than at exchange of contracts.

Do all the licensed conveyancers and solicitor practices listed on your directory have online case tracking as I understood that this was a condition of being on the Clydesdale Bank solicitor panel?
No. There is no CML Part 2 or Building Society Association requirement relating to online case tracking. Some law firms operate such technology and some don't.
I am attempting to get my former partner removed the mortgage deeds. Can Clydesdale Bank really tell me which solicitor I can or can not instruct?
You can use any solicitor you like but Clydesdale Bank then has the right to appoint a different solicitor to act for them at your expense. It might be more cost effective and quicker to instruct a lawyer who is on the Clydesdale Bank solicitors panel
I had instructed online solicitors located in Manchester who are on the Clydesdale Bank solicitor panel. They are now charging me a separate fee of £175 for dealing with the Clydesdale Bank mortgage. Is this a supplemental conveyancing fee set by Clydesdale Bank?
Unfortunately, as long as it is in their Terms and Conditions or Quote then yes your solicitors can charge a fee for this. This fee is not set by Clydesdale Bank but by your lawyers. Some firms on the Clydesdale Bank will charge an ‘acting for lender’ fee and others do not.
How can we tell if a solicitor on the Clydesdale Bank panel is any good?
obtaining recommendations is a sensible starting point. Before you go ahead check if they offer a no sale no fee offer. Also you often get what you pay for - a firm which quotes more will often provide a better service than one which is cheap as chips. We would always advocate that you speak with the lawyer carrying out your conveyancing
I am currently in the process of buying my council flat. I have a mortgage agreed with Clydesdale Bank. Conveyancing is new to me. Can I proceed without a solicitor easily? I think we can but we keep being told I should have one. Any advice?
It is not advisable proceed with a house purchase without a solicitor. The council's solicitor are not acting for you. You need a solicitor for a number reasons. One of which is to verify what plans the Council have for repairs and refurbishment for the next five years. Many leaseholders have been stung for contributions of thousands of pounds. In any event if you are getting a mortgage with Clydesdale Bank you will need to appoint a solicitor on the Clydesdale Bank conveyancing panel.
