Capital Home Loans Conveyancing Panel : Questions and Answers
I would like to know the reason why all property lawyers are not on the Capital Home Loans Solicitor panel?
Capital Home Loans and other banks tend to imposes restrictions either the type or the number of conveyancing firms on their panel. A common example of such restriction(s) being that a firm must have two or more partners. In addition to restricting the type of firm, some have decided to limit the number of firms they use to represent them. You should note that Capital Home Loans have no responsibility for the quality of advice provided by any member of Capital Home Loans Conveyancer Panel. Mortgage fraud was a key driver in the rationalisation of conveyancing panels a few years ago and whilst there are differing views about the extent of solicitor involvement in some of that fraud. Statistics from the Land Registry reveal that thousands of law firms only carry out one or two conveyances a year. Those supporting conveyancing panel cuts ask why law firms should have the right to be on a Lender panel when clearly, Conveyancing is not their speciality? To put it another way; would you want a conveyancing solicitor to represent you if you were charged with a crime; probably not.
We are approaching an exchange and my parents having sent the 10% deposit to my lawyer. I am now advised that as the deposit has not come from me my lawyer needs to disclose this to my lender Capital Home Loans. Apparently, being on the Capital Home Loans conveyancing panel and acting on their behalf he must inform Capital Home Loans if the balance of the mortgage advance is coming from anyone other than me. I disclosed to the bank about my parent’s contribution when I applied for the mortgage so is it really necessary for this now to be an issue?
Your lawyer is obliged to check with Capital Home Loans to make sure that they are aware that the balance of the purchase price is not from your own funds. Your solicitor can only report this to Capital Home Loans if you agree, failing which, your lawyer must cease to continue acting.

I am attempting to get my ex-wife removed the mortgage deeds. Can Capital Home Loans really tell me which solicitor I can or can not retain?
You can use any solicitor you like but Capital Home Loans then has the right to appoint a different solicitor to act for them at your expense. It might be more cost effective and quicker to instruct a lawyer who is on the Capital Home Loans solicitors panel
My fiance and I are in the process of looking at flats and now considering a potential offer. Is it best to have a conveyancer on ‘stand by’? I intend to finance via a home loan with Capital Home Loans
It would be sensible to have your start your search soon rather than later. After you have chosen your lawyer and once your offer is accepted you can instruct them to work for you and pass their details on the the EA. As you are getting a mortgage with Capital Home Loans , make sure you remember to check that your lawyer is on the Capital Home Loans conveyancing panel.
I was told two weeks ago that my mortgage has been agreed
to by Capital Home Loans. Is it usual for Capital Home Loans to only issue the offer once my
solicitor is approved on their conveyancing panel?
A lender would not issue a mortgage until they have details of a lawyer on their panel. It can take a few weeks for Capital Home Loans to deal with your lawyers application to be on the Capital Home Loans conveyancing panel. There's no guarantee that your solicitors will be accepted.
At last I have had an offer on an apartment accepted, but there is a chain. The vendors have offered on somewhere, but not been accepted yet, and have viewings of other properties booked. My conveyancing solicitor has been instructed. What do I do now? When should I get the mortgage app going with Capital Home Loans?
It is usual to have concerns where there is a chain as you are unlikely to want to be too out of pocket too early (mortgage application is approx £1k, then survey/valuation, conveyancing search costs, etc). First you should check that your solicitor is on the Capital Home Loans conveyancing panel. As to the next stages this very much depends on the circumstances of your case, desire for this property and on the state of the market. In a hot mortgage some buyers would pally for the mortgage with Capital Home Loans and pay for the valuation and only if it comes back ok would they pay their solicitor to press on with searches.
