I need to swap lawyers as my lawyer is not on the Britannia panel of conveyancing solicitors. Is it advisable to appoint a new law firm?
If you haven't yet instructed a solicitor to do anything for you and have just received quotes, you're perfectly free to choose a different solicitor to carry out your work for you. The best way is to get recommendations from friends or family who have actually used the solicitor or conveyancer you're considering.
My nephew is about to exchange on a house that has just been built with a home loan from Britannia. His conveyancer has said that there is a delay in receiving the ‘Disclosure of Incentive Form’. This document is news to me - what is it and who needs sight of it?
The form is intended to provide information to the main parties involved in the transaction. Therefore, it will be provided to your son’s lawyer who should be on the Britannia conveyancing panel as a standard part of the process, and to the surveyor when requested.
The Developer will be required to start the process by downloading the form and completing it.
The form will therefore need to be available for the valuer at the time of his or her site visit. The form should be sent to the Britannia conveyancing panel solicitor as early as possible, in order to avoid any last minute delays, and no later than at exchange of contracts.
I am planning to acquire a house and require a conveyancing solicitor in Leeds who is on the Britannia approved. Can you recommend a local firm?
Our service is a directory service for firms who wish to be listed as being on the approved conveyancing panel for Britannia . We don’t recommend any particular firm.
My house is up for sale and I have a buyer. Does my solicitor have to be on the Britannia conveyancing panel in order to deal with paying off my mortgage?
Ordinarily, even if your lawyer is not on the Britannia conveyancing panel they can still act for you on your sale. it might be that the lender will not release the original deeds (if applicable and increasingly irrelevant) until after the mortgage is paid off. You should speak to your lawyer directly before you start the process though to ensure that there is no problem as lenders are changing their requirements fairly frequently at the moment.
We have agreed a price on a apartment I spoke to a lawyer recommended by my mum and he advised using a law firm approved by Britannia. The estate agent recommended two local firms so I asked Britannia if the 2 suggested solicitors are approved, which they are not. Britannia suggested that either firm can fill out the appropriate forms to become approved. Do I (1) save myself the aggravation and use one of Britannia 's conveyancing panel solicitors (2) Use the local solicitor and accept there may be delays etc as they go through the approval process.
Enquire of Britannia for conveyancing panel firms in your area. Most banks have lawyers on their panel throughout the UK. You can also use our search tool at the top of this page to search for a lawyer on the Britannia conveyancing panel based on location. If you particularly like the sound of one of the local lawyers that you have spoken to ask them if they would go onto Britannia conveyancing panel as it may only take about 2-3 weeks. As long as they meet Britannia’s requirements it can be a very simple job for the solicitor. Other stuff will be going on in parallel (as you are at an early stage) so it may not delay matters.
Can I register a complaint to Britannia about the lawyers being on the Britannia conveyancing panel?
There is little point in complaining directly to Britannia. Every solicitor firm and conveyancer must have a complaints procedure. You can get information from the solicitor’s or conveyancer’s website or ask at their office. They must tell you about it if you ask.
The Legal Ombudsman will make sure that your complaint is addressed by the solicitor. It can also advise you how to complain.
If a licensed conveyancer does not have a complaints procedure or will not tell you about it, contact the Council for Licensed Conveyancers (CLC), which will make sure that your complaint is properly dealt with by the conveyancer. Please see below for more information.
Britannia have agreed my mortgage in principle, my offer on house has been accepted, now what?
The estate agent will want to know who your solicitors are (make sure these solicitors are on the lenders panel). Call up Britannia or your broker and complete any relevant paperwork. Britannia will tell you what documents they want. Britannia will instruct a valuer. The valuer will get in touch with the estate agent or seller to book an appointment. Once conducted (assuming no problems) it takes about week to get a mortgage offer. Britannia will issue the offer to you and your lawyer. The transaction will then take it’s course according the nature and complexity of the conveyancing.
