My property lawyer is not listed on the April Mortgages Approved Panel. Can I still retain my family solicitor even though they are not on the April Mortgages list of approved lawyers?
You will need to have a conveyancer complete the legal work required when you take out a April Mortgages mortgage to buy your property. They’ll carry out all the necessary legal checks on the property, make sure that you’re properly registered as the owner and ensure that all the necessary mortgage documentation is in place. You can instruct a conveyancing firm of your choice. You can use any solicitor you like but April Mortgages then has the right to appoint a different solicitor to act for them at your expense. It might be more cost effective and quicker to instruct a lawyer who is on the April Mortgages solicitors panel
The mortgage over my property is with April Mortgages. Conveyancing has been completed 12 months ago. In the event that I decide to rent out the flat and do not currently have a buy-to-let mortgage do I need to remortgage to a BTL mortgage or inform April Mortgages?
You must advise April Mortgages before renting your property as this is likely to be a breach of April Mortgages’s mortgage conditions. It may be that April Mortgages will permit you to let out your former home without needing to switch to a buy-to-let mortgage but some lenders will add a surcharge to your mortgage rate to reflect the higher risk. You should contact April Mortgages directly. It should not be necessary to do this via a April Mortgages conveyancing panel firm.
It is not clear whether my mortgage offer obliges me to make sure the lease term for the flat is extended prior to the completion date . As long as the conveyancer is on the April Mortgages panel she or he must comply with the CML Handbook requirements for April Mortgages. Unless your lawyer obtains specific confirmation in writing that April Mortgages will go ahead your lawyer has no choice but to refrain from exchanging contract and committing you to the purchase. We would suggest that you ask April Mortgages to contact your lawyer in writing confirming that they will accept the remaining number of years left on the lease.
Planning on purchasing a flat with a mortgage with April Mortgages. I have received an online quote from a licensed conveyancer, which states: "There will be no charge for dealing with the Building Society if you are obtaining a mortgage". I take this to mean that there will be no additional fee if the solicitor is on the April Mortgages conveyancing panel. I wanted to make sure it means there will be no additional fees for dealing with the mortgage.
They are simply saying that the cost for acting for the lender is included in the fee being quoted. It is worth you checking that they are on the April Mortgages conveyancing panel
