What is the rationale as to why all property lawyers aren't included on the Bank of Scotland Conveyancing panel?
Even though it may seem unfair for Bank of Scotland to restrict who can act for them from the public’s or solicitor’s point of view, the other side of the coin is that the lenders are becoming ever more anxious and feel the necessary need to protect them from mortgage fraud and other illegal activities. You should not exchange unless you have advised to do so by your lawyer. A precondition to being on the Bank of Scotland approved panel is to comply with the CML Handbook requirements (last updated for this lender on Bank of Scotland). The CML Conveyancing Handbook requires that your lawyer have the appropriate Disclosure of Incentive form completed by the developer and accepted by your lender.

Different lenders have different requirements but many of the Terms and Conditions of Conveyancing Panel Appointment require the file to be held for a period of 6 years. I have agreed a price on a apartment I spoke to a conveyancer recommended by my brother and he advised instructing a solicitor approved by Bank of Scotland. The estate agent recommended two local firms so I asked Bank of Scotland if the 2 suggested solicitors are approved, which they are not.
