I purchased a freehold premises in Didcot yet pay rent, why is this and what is this?
It is rare for properties in Didcot and has limited impact for conveyancing in Didcot but some freehold properties in England (particularly common in North West England) pay an annual sum known as a Chief Rent or a Rentcharge to a third party who has no other legal interest in the land.
Rentcharge payments are usually between £2.00 and £5.00 per year. Rentcharges date back many centuries, but the Rent Charge Act 1977 barred the generation of fresh rentcharges post 1977.
Previous rentcharges can now be extinguished by making a lump sum payment under the Act. Any rentcharges that are still in existence after 2037 is to be dispensed with completely.
My lawyer in Didcot has never been on on the Solicitor Panel. Is it possible for me to use my family solicitor even though they are not on the list of approved lawyers?
The limited options available to you here include:
- Complete the purchase with your preferred Didcot solicitors but will need to instruct a lawyer on their panel. This will inevitably rack up the overall conveyancing fees as well as result in delays.
- Find an alternative solicitor to act in the conveyancing, not forgetting to check they are on the panel
My wife and I are purchasing a house in Didcot. It might be a silly question but how we can trust a solicitor? On the day of competition we have to put money into their account. What protection do we have from them run away with our money?
Be assured that all money in a Solicitors client account is 100% safe, and even if your Solicitor ran off with it, the Law Society would reimburse you fully.
What is your number one tip for finding a conveyancing solicitor in Didcot
It would be unwise to be tempted by the lowest Didcot conveyancing fees. You really do get what you’re paying for when it comes to conveyancing solicitors. A cheap quote may mean that the conveyancing solicitor is handling a lot of jobs at one time and you won’t get the quality of service and the attention that you need. It is, however, wise to use a conveyancer who has a fixed fee on a no sale, no fee basis. This way, you know exactly what you’ll have to pay in ahead of time.
It is not clear whether my bank obliges me to make sure the lease term for the flat is extended prior to the completion date. I have called my Didcot building society branch on various occasions and was advised it wasn't an issue and they would lend. My Didcot conveyancing solicitor - who is on the mortgage company conveyancing panel- telephoned to say that they refuse to lend in accordance with their specific requirements. Who do I believe?
The has to comply with the Council of Mortgage Lenders’ Handbook Part 2 conditions for your bank. Unless your lawyer obtains specific confirmation in writing that the bank will go ahead, your lawyer has no choice but to refrain from exchanging contract and committing you to the purchase. We would suggest that you ask the bank to contact your lawyer in writing confirming that they will accept the number of years remaining.
